TERMS AND CONDITIONS

Gurudev EV Ride LLP — Effective Date: April 08, 2025

Welcome to Gurudev EV Ride LLP. By accessing or using our application, website, and electric vehicle rental services, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read them carefully before using our services.

1. Eligibility & User Account

  • Eligibility: You must be at least 18 years of age and legally competent to enter into a binding contract under Indian law.

  • Account Registration: To book rentals, you must create an account by providing accurate, complete, and current information. You are responsible for keeping this information updated at all times.

  • Identity Verification: We may require identity verification, including OTP-based verification, government ID validation, and liveness checks. We reserve the right to deny or revoke accounts that fail verification or risk checks in accordance with applicable laws.

  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials, OTPs, and any device used to access the App. You explicitly disclaim any liability towards Gurudev EV Ride LLP owing to unauthorized access resulting from your failure to secure credentials.

  • Unauthorized Access: You must promptly notify us in writing of any actual or suspected unauthorized access to your account.

2. Relationship with Vehicle Hire Agreement

  • Separate Agreement: Any hiring, leasing, or use of E-Bikes shall be governed strictly by a separate, independent Vehicle Hire Agreement executed between you and Gurudev EV Ride LLP. That agreement will contain vehicle-specific terms, safety requirements, insurance details, deposit and penalties, charging or swapping rules, loss and damage allocation, and operational obligations.

  • Order of Precedence: In the event of any inconsistency between these Terms and the Vehicle Hire Agreement in relation to E-Bike hire, the Vehicle Hire Agreement shall prevail. These Terms continue to govern app access, payments through the App, and other digital services.

  • Independent Relationship: Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between you and Gurudev EV Ride LLP.

3. Consent to Data Collection and Processing (DPDP Compliance)

  • Statutory Consent: By using the App and accepting these Terms, you expressly, freely, unconditionally, and unambiguously consent to the collection, access, use, processing, storage, sharing, and disclosure of your personal data by Gurudev EV Ride LLP in accordance with these Terms, the Digital Personal Data Protection Act, 2023 (the "DPDP Act"), the Digital Personal Data Protection Rules, 2025, the Information Technology Act, 2000, and applicable rules.

  • Personal Data: Personal data such as name, contact details, date of birth, identity information, photographs, driver's license details, and other KYC details.

  • Business Information: Business and commercial use information such as GST details, business name, and business contact information in connection with commercial subscriptions or invoicing.

  • Usage & Device Data: Usage and device data such as App interactions, device identifiers, IP address, location information, telematics data, trip and route data, and battery status.

  • Lawful Basis: Processing includes your consent for performance of a contract, compliance with legal obligations, and our legitimate interests (such as security, fraud prevention, and service improvement).

  • Children's Data: The App is intended for users who are 18 years of age or older. We do not knowingly collect personal data of children under the DPDP Act.

4. Third-Party Disclosures & Security

  • Third-Party Sharing: You acknowledge and consent that we may share certain user data with our trusted third-party service providers strictly for operational, verification, security, and compliance purposes, including identity verification and KYC service providers (such as Aadhaar-based verification via UIDAI-authorized entities and driver's license verification through lawful channels) and payment processors.

  • Breach Notifications: We maintain incident response procedures and will notify the competent authority and affected users as required under applicable law in the event of a personal data breach.

5. Bookings, Payments & Refunds

  • Reservations & Pricing: Bookings are made through the app, and payment is required at the time of booking. Pricing is based on rental duration and the type of bike selected. All payments must be made through available app payment methods.

  • Refunds & Cancellations: Refunds for cancellations or issues related to rentals are subject to the Return Policy and may not be applicable under certain circumstances (e.g., damage to the bike, delays in returning the bike).
